Whether a transgender woman can apply for change of name and gender in her educational documents and passport?

KEY FACTS

Vishnu Priya is a transgender woman who applied for changes in her identity documents after undergoing sex-reassignment surgery. She wanted her gender and name to be changed in her passport and educational certificates.

The Court considered Vishnu Priya’s claim to issue fresh certificates. There were no arguments against her application. The Regional Passport Office required Vishu Priya to submit an affidavit and newspaper publication notifying the public of the name change.

The Court directed the educational authorities and passport office to consider Vishnu Priya’s application expeditiously.

SIGNIFICANCE

The government authorities did not try to argue against Vishnu Priya’s claim in court.
